How can I get sole custody of my son?
I understand that Florida is more so than not considered a 50/50 state. However, the parenting plan I have with my child is pretty limited already which was put in place when my son was 2. According to an attorney I spoke to recently said he hasn't seen a more limited parenting plan. Even with the restricted parenting plan he could never keep his visits consistent and more than not could not keep the schedule and when he did show up for his visitstion i would have to physically force him in the car. Well 5 years ago his dad dipped. Only heard from him twice asking to see him and each time was after he got served with contempt paperwork for non-payment. This last contempt for non payment he filed contempt of court on me but dropped it when I agreed to let him start seeing my son again. I cant include much more information because of the limited characters. I HAVE to get sole custody my son. Emotionally my son is not safe with his dad alone. I know for a fact his dad bad mouths me around my son. Plus more! Please what can I do to get sole custody? There HAS to be a way!
Unfortunately, while I do not practice family law, it would be very unlikely that any attorney out here on AVVO will have any better analysis of your situation than the attorney who already provided their opinion based on a actual review of the court documents. What the facts here suggest (like many others posted here on AVVO) is that a demand for payment of child support resulted in an otherwise absent parent suddenly insisting on custody/visitation rights. My GUESS is that many of these absentee parents would give up custody or visitation in exchange for the dropping or decrease in the support payments, but would require consultation with experienced family law counsel as to whether this is feasible legally and practically.
