DUI

My question is if someone had a DUI and in less then 4months they get a second DUI and the have court next week but they have been drinking no driving only drinking at home are there any chances they can go to jail? If yes how long?

Yes, if the case is not resolved yet, there is definitely a chance that the court orders that the person post bail, install an ignition interlock in their vehicle, and require an alcohol monitoring bracelet. If there is already a conviction on the first DUI the court would also be required to impose a 30 day sanction. The prosecution is going to be very aggressive in arguing for condition and sanctions . You need an attorney. The tough part of being a DUI attorney is having the courage to be real with clients. My experience is that lots of people get arrested for DUI. Most of them never come close to getting another one. The people that get two DUI within years of each other, often go on to get more DUIs and keep going until they have completely ruined their lives. Please connect with a substance abuse treatment agency to see if they can help you avoid getting a third DUI. Maybe next time you'll just be driving along and someone will crash into you and get injured and, even though the accident was not your fault, your facing a prison sentence for vehicular assault.
