Question

Can my husband move his 37 yr old son into our home without my permission?

My 37 yr old step son cannot keep a job. Has never had one for more than 3 mos. My husband still helps him finacially, continuing to enable him. His son is disrespectful and hostile towards me, verbally, not physically.

His son moved out less than a year ago after a 3 mos stay turned into almost 2 yrs, He is about to lose his current place to live. I am afraid my husband will try to let him stay here again. Do I have any rights to prevent this?

We own our home together. We have no mortgage.

This sounds more like a family relations problem than a legal one. ////////////////////////////////////////////////////////////////////

Please do not direct message me because AVVO doesn't link DMs to posts. Comment instead. Do not call me. I will not take your case. I am not your lawyer. My response is for information purposes only. If you want legal advice, seek the advice of an attorney licensed in your state. I write in short sentences, and I try to answer the question you asked. Short sentences are not rude.

Any owner of real property can permit someone to occupy the premises. So, yes, your husband can permit his son to occupy the premises. If you are the co-owner of the property, you have authority based on your percentage of ownership. In general, when 2 owners cannot agree on how to use real property they own jointly, they have the ability to file a partition action, in which the court can order division or sale of the property. There may be other legal options as well, but you'd need to get a consultation from an attorney for advice.

Legal Consult Recommended
An attorney has indicated that they believe this person will require a legal consultation

This is not meant to be legal advice but only a general response to a general question. Legal advice requires more attention to details and circumstances to be accurate and reliable. Do not rely on this response as legal advice. If you want legal advice about your matter, you must set up a consultation with this attorney.
