Question

Can I send this dog to a rescue or shelter without breaking the contract?

I purchase the dog from rehome adopt a pet website. Details of contract below. It states what must be done if i need to rehome. I called the owners, they don't want him back. With this verbiage do i have to rehome him while he living with me or can i send to a shelter and or rescue who have resources to help find a home.

I understand and hereby agree that the Owner makes no representations or warranties, express or implied, statutory or otherwise about the Pet, including its temperament, breed, health, or other characteristics or the suitability of the animal to the Adopter and/or family. I, the adopter, hereby agree to care for the Pet in a humane and responsible manner and to provide him/her with clean and adequate shelter, food, water and veterinary care.If at a later date I am unable or unwilling to keep this Pet, I agree to first immediately contact Owner and give them the option to reclaim the Pet. If I ever need to rehome this Pet, and cannot reclaim this Pet, I agree to try in good faith and using my best efforts to find a new home for this Pet while keeping him/her in my home, and to always act in the best interests of the animal.

'If at a later date I am unable or unwilling to keep this Pet, I agree to first immediately contact Owner and give them the option to reclaim the Pet. ' ● ● You did that. Now you can re-home him with someone or re-home him to a shelter. The breeder doesn't care, and will not even spend filing fees to sue you to enforce that "contract" .

● NO Artificial Intelligence text generator was used to write the above answer. ● NOTICE! ● I am not your attorney, and this is NOT a consultation. ● Please do NOT private message me. ● I am an Attorney-at-Law, licensed to practice law ONLY in the state of California. ● My discussion of issues is NOT legal advice, and unless we have both signed a formal retainer agreement you are NOT my client.

As a practical matter, do not fool yourself that a shelter has better "resources" to find this dog a good home. Shelters are inundated with stray and abandoned dogs and they may only have a few days before they are subject to being euthanized. While the question state zero facts on efforts you might have made to find the dog a good home, if you can't be bothered to take the time to actually try, please find a no kill rescue that will take the dog. Best of luck to your pup.
