Marriage of Wade
Oct 18, 2007OUTCOME: My client was named the primary parent.
I represented the mother, Cindy, in both her initial dissolution action in 2002 and in a subsequent 2007 parenting plan modification action filed by the father. Both actions were high conflict matters ... where the father made serious physical and sexual abuse allegations against the mother and sought to limit her time/contact with the children. The dissolution action settled prior to trial. The modification action went to trial, which lasted 3 weeks. During the proceedings and at trial, the mother argued that the father was engaging in abusive use of conflict and parental alienation and presented substantial evidence refuting the father's claims. The modification action concluded with the mother remaining the primary parent and with the father having to pay a share of the mother's attorney fees.
