Client charged with driving under the influence of prescription drugs. After obtaining information from client's physician that symptoms of intoxication resulted from a medical condition (not drugs) D ... .A. agreed to dismiss, on the day of trial.
OUTCOME: CASE DISMISSED by Judge at Preliminary Hearing

At the preliminary hearing, I argued th ... at the D.A. had not proven that the gun belonged to my client. Judge agreed and dismissed the case.
OUTCOME: HUNG JURY (not convicted) - 8 jurors voted not guilty; 4 voted guilty
Client charged with driving under the influence. At the time of arrest, his blood alcohol level tested .23 (almost 3 times the legal limit). He was stopped by the police after his car broke down on ... the side of the road; when the police came to the scene, client was alone and admitted that he had been driving when the car became disabled. At trial he claimed that his brother had actually been driving and that his brother had gone to get help, when the police arrived.
OUTCOME: DEFERRED PROSECUTION. I negotiated with the D.A. to do a deferred prosecution – Mr. O. did not have to plea guilty, the prosecution was deferred for one year, and will be DISMISSED at the end of the year if Mr. O. stays clear of any re-arrest.
Mr. O. was charged with three counts of felony receiving stolen property and felony unlawful taking of a vehicle.
OUTCOME: Finding of FACTUAL INNOCENCE. To clear Mr. M.'s arrest record, I filed a Petition for Determination of Factual Innocence (P C 851.8). After evidentiary hearing, the Judge ALLOWED the Petition and ordered Mr. M.'s arrest record sealed and destroyed.
Mr. M. was arrested and charged with misdemeanor 273.5 (willful infliction of corporal injury on a spouse). Eventually, the charges were dropped but Mr. M. still had an arrest record that he wanted cl ... eared.
OUTCOME: A jury found Mr. V. NOT GUILTY of vandalism & battery; jury HUNG on the assault charge (D.A. then dismissed). Judge sentenced Mr. V. to 30 days on the remaining charges, which he was permitted to do in the Sherriff’s Work Alternative Program(not in jail).
Mr. V. was charged with six counts of misdemeanor assault, battery, exhibiting a deadly weapon and vandalism. District Attorney refused to settle the case for anything less than six months jail time.
OUTCOME: Mistrial declarred on 5th day of trial - case DISMISSED. District attorney wanted to re-try the case, but finally came to his senses and offered an "infraction" (no criminal record for Mr. C.)
Mr. C. was charged with misdemeanor assault with a deadly weapon, and willful infliction of corporal injury on a former spouse. He refused to take a plea bargain because he said it just didn't happen ... - so we took it to trial.
