Possession of marijuana 1st offense can result in up to 30 days in jail. It is a misdemeanor.

You cannot take the 5th unless your answer would incriminate you. You need to discuss this matter with an attorney.

I agree with Mr. Keller. A summary conviction is expungeable after 5 years if you don't get in any more trouble.

The issue of the attorney not being given time to prepare for trial is a definite issue. The lawyer is ineffective if not prepared.
