They have the power to forgive. In most cases papers must be RECEIVED by the deadline.

One month isn't a long time for administrative processing ... mandamus lawsuits are expensive and rarely produce positive results.

Keep in mind that, after filing for the EAD you will have to go in for biometrics about 4-8 weeks later.
