It is ok to stay in the US while waiting for the decision. DO NOT START SCHOOL EARLY ... be prepared to leave the US immediately, if the change is...

It was not denied because they were coming back within 6 months ... it was because they said something that wasn't the truth. They need a waiver...

If you filed an I-130 and if he went home, and stayed home, then you should be able to finish the process at the US consul in his home...
