Client faced administrative separation for allegations that he abused his position of leadership as an NCO by wrongfully engaging in a sexual relationship with a married junior soldier (initial entry t ... rainee) and improperly used his rank and position for personal gain by pushing for sexual favors. At the board hearing, the government failed to call any credible witnesses and even failed to call the accuser as a witness. The government relied purely upon documentary evidence, but the defense was able to show that these allegations were completely unsubstantiated. In fact, the defense introduced evidence demonstrating the accuser had a history of instability, false accusations, and severe mental health issues casting doubt upon the accuser's credibility. RESULT: CLIENT RETAINED IN MILITARY SERVICE. NO ADMINISTRATIVE DISCHARGE.
