Yes you can certainly sue them civily. The question you have to ask yourself is will you recover anything.

The POA should still be valid. They are valid until revoked or the person who granted the power dies.

Statutory Rape is a crime period. The child that was impregnated by the adult has no say in the prosecution of the criminal activity.
