I think she got her license out of a box of cracker jacks...

Upon being appointed Jayne Mitchell as my attorney in a Reckless Driving ticket 1st offense case. I am a 35 year old woman who has only had a "speeding ticket" once in my life time. I was 20 years old driving across country to meet my biological father for the first time. Montana had a "NO Speed Limi...t Law", that being considered reasonable and prudent. Being cited for reckless driving and the circumstances around those chargers were complete B.S. Jayne being my assigned attorney was impossible to get a hold of. Her voice mail box was always full for months! I still always left a txt message return my call text message upon prompted. She did get a hold of me finally the day before my trial set to meet me at the library. She let me know that she had talked to the district attorney and the judge and they insisted I plead guilty. I explained to "MY" attorney what happened and that indeed that no reckless driving charges should have even been filed. She continued to insist I plead guilty. I asked her what the definition of Reckless Driving was. She didn't know. I informed her that we were in a library and had access to the law library. She went and found the book looked it up and read it and I reread it and she still told me I just needed to plead guilty. I informed her that I am entitled to view this evidence they have against me including the statement of my accuser. She failed to even produce it and asked for a continuance. This went on and on and on. She didn't even show up for court more than once. The first time I actually walked across town to show up for court early only to find out that my attorney asked for a continuance due to inability to get the statement of the accuser for me to review before the trail. The next time she didn't show up 1 1/2 later mind you. The judge didn't even know what to do when an attorney doesn't even show up to trial. The prosecuting attorney suggested a arrest warrant be issued for failure to appear considering that is exactly what would have happen to me if I didn't appear in court. Judge Payhut was dumbfounded as to why Jayne Mitchell kept not appearing in court. A new court date was filed and I was told that they would appoint me a new attorney. My new attorney George J. Pearce III picked up the case and worked on my behalf like an attorney is supposed to do! George did an amazing job preserving my rights and going to the mat against the charges given the lack of cooperation by the court system.

I am unable to respond to this reviewer's complaint point by point because of client confidentiality concerns. However, I wish to assure my former and future clients that I uphold high professional standards. As is pointed out on the AVVO website there are no professional responsibility marks against my record and I have been practicing law for 37 years. I have been an elected and appointed official in State and Local government on several occasions. I have also been the General Counsel for a highly respected construction company. I am currently an elected official in county government. I therefore wish to respond and keep my reputation clean. Thank you.
