I agree with my colleagues. If service was defective, if can be easily cured. The purpose of the summons is to put you on notice of the lawsuit....

I agree with Mr. Campanella. If you have a bona fide case of mortgage fraud, there are plenty of attorneys in NYC who will agree to represent you.

You may want to see if he will voluntarily deed the house to you.
If you get the home, you can then evict the tenant.
