I agree with Mr. Jackson. Your contract will control what you were required to pay by way of earnest money deposit.
Is it considered perjury in arkansas if someone makes an affidavit that is false whether knowingly or unknowingly ?

Fraud or perjury are intentional acts. One cannot "negligently" commit common law fraud or perjury.
