Made motion to strike the 2 texas DUI's as they did not meet the requirments in California for prio ... rs that can be charged. GRANTED. Also challenged refussal as it was not shown he refussed at preliminary hearing. REFUSSAL DISMISSED. Original offer was plead to felony and stipulate to 16 months state prison. Now he is only faceing second time dui without a refussal as a misdomeanor!. The penalties for that in san diego are 96 hours custody, fine and multiple conviction program.

Pic ... tures of scene showed that it was impossible for cop to see car coming towrad cop based upon cops location and 8 foot high wall obstructing cop view. Motion to supress evidence granted based on unlawfull stop. All observations and FST's and statmenst excluded along with test results of .15 BAC. Case dismissed
