Figure out the case status with the court, and most importantly, tender the matter to your insurer, who hopefully will provide a lawyer/defense....

I'd stick to genuineness and use form DISC 020 and MC 025. Then separate items for truth of facts.

You can't go after the other driver's insurer, since it didn't hit you, but you can go after the other driver directly if the situation warrants....

I think the general prohibition covers mere detentions and, surprisingly, expunged convictions. But undisposed arrests apparently are fair game....

Generally not liable but there can be exceptions (e.g., Ray v. Alad), so if potential claims are significant it'd be well worth a full legal analysis.
