Driver was stopped for driving without headlights and was investigated for driving under the influence of alcohol. The driver performed field sobriety evaluations and kept his foot up for thirty secon ... ds without putting his foot down. The driver declined to provide a breath sample for the Intoxylizer 5000. At trial, counsel showed the solicitor the evidentiary problems with the initial stop and the lack of indications of impairment. The charge was reduced to reckless driving.
