The driver performed field sobriety evaluations and kept his foot up for thirty secon ... ds without putting his foot down. The driver declined to provide a breath sample for the Intoxylizer 5000. At trial, counsel showed the solicitor the evidentiary problems with the initial stop and the lack of indications of impairment. The charge was reduced to reckless driving.

Driver was stopped for driving the wrong way through a left turn ramp to his hotel. The Officer investigated for impaired driving and requested that the driver perform field sobriety evaluations. Upo ... n arrest, the driver declined to provide a breath sample for the Intox 5000. The driver was cited for driving the wrong way and DUI-less safe. Long before the trial date, cousel's investigation revealed defects in the citations, including a lack of an allegation of venue in the charging instrument, that would require dismissal. On trial date, all charges were dismissed.

Driver was met in the parking lot after a bumper tap. The Officer investigated and arrested the driver for DUI. The driver provided a breath sample slightly under the legal limit. The case was pendi ... ng for over one year, during which time the driver moved overseas. Before the case was called for trial, the solicitor agreed to reduce the charge to reckless driving, and the driver did not even have to return to court to enter the plea. By the time of the plea, requirements of DUI school and an alcohol evaluation were removed from the sentence.

Driver was stopped for having a tag light out. Officer being trained requested field sobriety exercises. After stimulus passes for the horizontal gaze nystagmus test were way too fast, and after the ... defendant kept his leg straight and his foot up for thirty seconds, the officer conferred with the training officer, commenting that he believed "that was not a pass. None of that." Defendant's second charge of DUI in five years was reduced to reckless driving.
