At trial 3 witnesses testified that my client was angry and attacked the alleged victim, punching ... and kicking him repeatedly. The alleged victim also said the Defendant was angry and violently assaulted him. At jury trial I was able to show that the victim had made multiple inconsistent statements under oath in regards to his injuries which called into question his credibility. The jury came back with an acquittal on the felony 2nd degree assault and a conviction on a misdemeanor 4th degree assault. The parties agreed to a probated sentence.
