You can always file for custody whether you win is up to the court. A criminal record and pending criminl charges does not help your case.

each case is decided based on the facts so if you need protection of the court then file the petition.

The court decides each case based upon the best interests of the children. You are right courts do not like to shuffle kids around.

You have to file a motion to get the child back. The grandmother has custody pursuant to Chapter 751, Florida Statutes.

You cannot relocate without court permission or the written consent from your ex.
How do I remove the supervised visitation order and have it changed to non supervised. My wife agrees with this.

If your ex agrees then prepare a stipulation and order and send it to the court. Otherwise file a motion and set it for a hearing with the court.
