I am a NY lawyer in my opinion you are legally married despite the clerk mistake.
How is joint child custody affected if one parent is sentenced to serve time in prison? Can I file for sole custody?

If your ex is in jail or is about to be then yes you will get sole custody. You should use a lawyer.

you have legal rights so long as you enforce them. Doubtful you will get 50/50 custody if you are 8 hours apart.

You are responsible for showing up if under subpoena unless excused (preferably in writing) by the attorney.
