You have to report it as income. Anybody can pay anybody else's debt. It is not a donation to you.

One cannot garnish wages without a judgment. Judgments are good for 12 years and then they can be renewed.

Only if you brother had a residence in Maryland at the time of the accident, can you sue here. Otherwise, get an attorney where he lived, or CA.
