What??? You don't have to be arrested to be indicted, but they usually want to get your side of the story and any admissions first.

You need to beat this charge. Prosecutors rarely allow theft charges to be expunged. M1 thft is 1000 and up.

Yes. But you are going to have the same problems as anybody with a theft conviction - few will fire thieves.

Even if you didn't have the DUI, prosecutors rarely allow expungements of theft offenses.

If it is a condition on your probation and you don't get permission or your probation transferred....you can go to jail.
