Is it considered fraud to the IRS at the non custodial parent claim the child or does the court in agreement override that?

The Court order is what counts. It is not a fraud.

Tell the judge your attempt to get a lawyer and ask for a continuance to hire another lawyer. That's your best shot.

either you bring a lawyer or not. Judges are unlikely to give you more time to get a lawyer.

No such thing. Fines hang around and one day a warrant can issue and you can be arrested.
