I signed an 80/20 purchase money loan in Calif. The home was foreclosed Feb. of '09. The 2nd was charged off. Is that legal?

If the 2nd was charged off, I concur with Attorney Fink. I would not recommend paying the 10%.

Your question does not indicate whether your name is on title to the house. An owner of the house (or one of the owners) cannot be evicted.

The CIV-100 form I filed was rejected do to it not being filled out completely. The tenants have since paid all rent owed me.
