OUTCOME: Not Guilty
This was a case where, despite the case being he said/she said, client had serious impeachable felony convictions and, therefore, was advised not to testify. My mission became to trap the alleged vict ... im into every lie she'd ever said to anyone about this case. We were able to impeach her, on the record, at least 3 times using the police report and her written statement. Jury Verdict.
OUTCOME: Judgment of Acquittal
The Defense presented a clear case of "Stand Your Ground" to the Jury throughout the course of the trial. Unfortunately, you can't always know who is on your jury, and the jury came back with a guilty ... verdict. The Judge reserved ruling on the second Judgment of Acquittal argument and brought us back for a ruling. He found my client Not Guilty, overruling the Jury's verdict.
OUTCOME: Dismissed
State brought a case of trespass with one witness. During testimony of one witness, find that witness neither arrested our client, nor issued the trespass warning. The Defense strenuously objected to ... the trespass warning coming into evidence and objected to the witness testifying about (frankly) anything. The Judge sustained the objections. State attorney realized that they could not go forward to the Judgment of Acquittal stage of trial and voluntarilly dismissed the case knowing that Jeopardy had already attached.
OUTCOME: Not Guilty, all counts
Client was in custody for a theft that allegedly occurred at a local department store. There was video evidence that was purely circumstantial in nature. Loss Prevention Officer testified that he show ... ed his badge before tackling my client as he came out of the door. I used the video evidence in cross examination and asked him to point out where he can show on the video that he showed his badge. He was unable to find the portion of tape as it did not exist. I argued to the jury the circumstantial nature of the video showing no actual footage of concealment, and argued that the loss prevention officer was a liar and battered an innocent man.
