However, a visit to the scene of the crime and a chat with the victim at the scene revealed that the victim only assumed Mr. H took the bicycle from the patio. At trial, the victim had to admit that he did not see where Mr. H had taken the bicycle and that it was possible Mr. H took the bicycle from somewhere other than the patio.

Mr. D was wrongfully charged with Grand Theft Auto. Mr. D met the alleged victim at a local gay bar. After becoming friendly, the alleged victim invited Mr. D to his home and gave him a ride to his h ... ome. The next day the alleged victim woke up at his home and found that his vehicle is missing. The alleged victim later finds his vehicle parked near Mr. D's neighborhood. Mr. D testified that the alleged victim was under the influence of alcohol and drugs that night, that Mr. D spurned the sexual advances of the alleged victim and asked for a ride home. By the time the alleged victim dropped off Mr. D at his home, he is highly intoxicated and is unable to drive. Mr. D and a witness both testify that Mr. D put the alleged victim in a taxi cab and parked the alleged victims vehicle in a public parking spot. The jury believed the victim was so intoxicated that he blacked out and forgot the events of the night.
