Court has no jurisdiction over new wife, and sounds like the ex isn't man enough to handle this issue himself. So nothing a judge can really do...

Presuming you agreed to adoption here. Yes you can use 401k. If a QDRO is needed (Rare for 401k's), get a court order, trust me, judge won't mind.
