Plaintiff, Colleen Hill, tripped and fell over tree roots at her condo complex. Plaintiff sued the HOA and property management company, alleging fault for creating a dangerous condition that allegedly ... caused her fall. Plaintiff settled with the HOA, leaving only the property management company as a defendant. I successfully persuaded the Court to dismiss the case against the property management company, and Plaintiff appealed that dismissal. The Utah Supreme Court affirmed the dismissal.
