In this action for personal injuries under Labor Law 200, 240(1), and common law negligence, the trial court dismissed the plaintiff's complaint on summary judgment. The plaintiff appealed and we were ... retained by the third-party defendant-respondent. The Appellate Division, First Department affirmed, finding that plaintiff was not engaged in a protected Labor Law 240(1) activity and that the defendants were not proper Labor Law defendants. The First Department also concluded that other claims were properly dismissed as well. As a result, the action remained dismissed against our client.
