Plaintiff claimed that State Farm wrongly denied her UIM claim arguing that coverage applied to the worngful death of her son, who was killed in an automobile accident. State Farm moved for summary ju ... dgment based on the construction of the insurance policy and Arizona's UIM statute. State Farm argued that because Plaintiff's son did not not live with Plaintiff and was not a named insured on the policy, UIM coverage was inapplicable.

OUTCOME: Court ruled in favor of client, Burch & Cracchiolo, denying defendant's motion for new trial and affirmed trial court's denial of defendant's summary judgment motion.

Burch & Cracchiolo ("B&C") sued Defendant Moore ("Moore") for failure to pay attorneys' fees. Moore filed a motion for summary judgment alleging that she was not responsible for the fees and that the ... Preston Trust was "in all likelihood responsible." Trial court denied summary judgment. Case went to trial, and the jury found Moore responsible for B&C's fees. Moore filed an appeal. The court of appeals affirmed the trial court's denial of Moore's summary judgment motion, denied Moore's request for new trial, and granted B&C's request for attorneys' fees.
