I have been misdiagnosed by a doctor and have proof by another doctor that works for the same company, do I have a case.

Leaving a device in the body during surgery is negligence per se.
You will need to retain local lawyer and you should do so at once.

Is this malpractice? I was diagnosed with GERD. I insisted it was more than that. I had chronic cough, ear ache, sore throat.
