If he has two strikes on his record, then he is looking at 25-life. Get an attorney asap.

On your facts, yes it sounds like you would be Prop 36 eligible, and yes you can get it even if you are convicted at trial.

Up to 4 years on the 10851 with the 666.5 allegation. If you can afford an attorney, get one. Otherwise one will be appointed for him at court.
