Mr. Millioen's client was charged with murder after defending himself from an assault by a violent attacker who ultimately died of a fatal brain bleed. The murder charge was dismissed at the preliminar ... y hearing after Mr. Millioen presented evidence that the attacker sustained a prior traumatic brain injury, participated in a fist fight earlier in the day which could have started his fatal brain bleed, and that there was no credible evidence that his client inflicted unreasonable force. The prosecution refiled the murder charge despite the judge's dismissal. After Mr. Millioen filed a motion to dismiss the charge (again), the government offered a plea bargain to settle the case: dismissal of the murder charge, which would avoid the overly harsh penalty of life in prison, for a plea to involuntary manslaughter with 4 years in prison.
