Yeah I had been drinking, but didn’t feel I was impaired when I left the house. I had just had two quick stiff cocktails and hadn’t planned to leave the house but then remembered I had a very expensive item to return before the return time ran out! Yikes, well I can make it to FedEx 2 miles away befo...re this booze hits me, sure! It would have been fine if some a$$hole in a black Mercedes GLE350 hadn’t rammed into me and took off. So the police accident investigator finally arrived nearly an hour after the fact who then calls the real police who then proceed to entrap me. Everyone in an accident needs to be aware that police do 2 investigations. An accident investigation and a criminal investigation! They are supposed to make it perfectly clear. You have to answer the accident investigation, by law, truthfully. On the criminal investigation you can as it is your right to STFU not day a word and DO NOT take any field dexterity tests. You only are compelled to take a chemical test, which you can also refuse but under penalty. So when Carlos caught this and filed a motion to suppress a bunch of damning evidence and do the lame ass SA gets the the police to file an amended statement to the effect, ‘oh I meant to say that’ in my original report. Even though we had 3 police reports and three depositions with not a whisper of my ‘accident privilege’ being clearly eulogized. WTF?! So Carlos goes ballistic and the SA decides ‘whoopsies’ maybe we need to cut a much better deal. No mind you we could have taken the motion to court and maybe it would have been found in our favor and the SA case would have been almost in the toilet because they would not have been able to, legally speaking, put me behind the wheel. Since I was up against a Rick Scott appointee for the judge I couldn’t be assured he wouldn’t ignore the technicality and give the SA a big fat sloppy kiss and send my life into a s$&@hole. So what could have been a serious problem became a reckless driving. Not that this has had no consequences but it could have been exponentially worse! Good Job Carlos!

About me: I was placed in an unfortunate situation where I was being convicted with battery;a misdemeanor. It wasnt my fault. I was never arrested nor questioned by the police. My first ever offence. I had no priors. Never been in trouble, barely missed school. Tried to apply to a job at the time ...and my background came back and the employer at the time said I had a battery charge. I was shocked and embarrassed. Didnt get the job obviously.
