We would assume so. An appeal would have told you if the trial court was right.

I will interject based on experiences outside TX…. The trial is de novo…. Not the case. The case is heard as filed, it’s a new trial only.
Can I win an appeal on a clause that was against public policy, but the contract was whole in 2015 when it was breached?

If the contract was void at inception it was void. In my mind the State is responsible for prosecuting not her, she can’t deliver a dismissal....
