You definitely need a lawyer. With a .08 the case may need to be tried. If you can't afford a lawyer have the judge appoint a public defender....

Well if it had occurred in California it would have been a felony but the FBI record should show it as a misdemeanor. Why does this matter to you?

If you are out on OR the court will not hear a bail hearing. What happens at the pretrial I know not. You should talk to your attorney.
