You cannot reopen the case. You may be able to apply for a 1203.4 dismissal, better known as a expungement. or if it is a felony for a 17b...

There is no requirement that the prosecutor has to make an offer. If the prosecutor wants the maximum sentence there is no reason to make an offer....
