You can serve them at any time. But if you're venturing into probate court in pro per, I hope you have an attorney to advise you from time to time.

Did you call the police?
Since you need to serve them in another state, you may have to bring this as a limited civil action instead of small claims.

Duplicate post. No you won't go to jail, but they can get a civil judgment against you for the amount owed, accrued interest and attorney's fees.
