Brian Lamar Ponder

Brian Ponder was hired by me to represent my clients in 16 cases. Brian requested $500 per case per client. $7500 was paid to Brian to represent 15 clients in 16 cases. 5 months go by and nothing was never filed. Brian refused to answer my questions about cases but insisted I have my clients contact ...him directly. He would respond to some of the messages but not all of them. 12 of the 15 clients never even got their contracts to sign. I text Brian one day and was complaining cause its been a month and nobody has gotten their contracts. Brian then emailed all the clients that he would be representing them and he'd send over a contract in the coming days. 2 months late and nothing. Ive had my clients email Brian to begin a paper trail of his misconduct. I have 100's of emails and text on Brian. I asked Brian for my money back and he's blocked me from all social media and removed me from all his credit groups. I am now forced to file chargebacks on Brian and leave these types of reviews on Brian. I shouldve read the reviews before hiring Brian cause this is obviously a trend with Brian taking clients money and doing no work. DO NOT HIRE BRIAN PONDER! Look up his cases in the state of New York. He hardly does any work.

Based on an industry referral, I contacted Brian to file suit against finance company and a student loan processor During consultation Brian agreed to represent me. He stated that he needed 1500 retainer fee for each suit filed. He stated those funds would cover out court filing fees and out of pocke...t fees related to filing. He stated that he would be compensated by including attorneys fee as damages and would be paid by lender. Once retainer was paid, my phone calls, text and emails went unanswered. Voice mail was not activated to receive messages. I reached out to the person who referred him, shortly after Brian emailed me and said he would be available following day. It was another 2 days before he called. He requested documents, I said I would call after sending. Very difficult to contact. Last conversation Brian, after months. Nothing done. Brian stated that he was not going to spend years working my case and he did I wouldn receive much because his fees would absorb any financial gain, leaving nothing for me. He instead offered to work on deleting items from my credit report instead. He accused of looking for a windfall. I asked for a refund to which he stated he would calculate his fees and return any amount left over. I told him that he had no right to keep it because the service he was ordering was not what I contracted or paid for and he hadn't done anything related. His response was to send me an invoice charging me for sending an receiving emails. Even the emails asking for updates and to contact me. Over 2500 .

Do not hire this attorney I hired him to address accounts for myself and husband in December 2018. This gentleman enrolled me into his program, collected payment every month and never work on either of our credit files. I attempted to reach him several times for a status update to which he never r...esponded. He never responded to any of my emails or calls. I reached out to him on 2/22/19, 4/3/19, 5/20/19 and eventually requested for full cancellation on 8/11/19. He finally admitted after speaking with him that he indeed did not do any of the work that was agreed upon. I requested for immediate cancellation and am going to be pursuing legal action to recover a refund for services not rendered. As he isn’t willing to refund me for services not rendered.

Due to an unfortunate situation where we are trying to save our home from partition action, we retained Brian Ponder. He explained to us that he had an unconventional approach that could supplement the work that our current attorneys were doing to keep us in our home as long as possible. Ponder told ...us he could help and the process would take approximately two months. We paid a retainer of $2500 with a monthly-automated payment of $1250 until the job was completed. He promptly became unreachable after the first installment of his pay was submitted. My husband and I would call him 3 or 4 times a day and his answering service would ensure that we never reached him. He rarely responded to emails and never responded to calls. During the month of May he was reached out to countless times to no avail. As we began nearing the second month of our engagement with him and we realized the negligent and unresponsive service we were receiving would continue, we stopped his automated payment at the suggestion of the neighbor who referred us. The neighbor (a fellow client) mentioned speaking with him about how unacceptable it was for him to drop the ball after he has been paid and the importance of being responsive. Upon realizing that the automated payment was terminated, he began contacting us via email and text, and threw together a sloppy counterclaim and filed it off the cuff. As it was near time for his next payment installment, he resurfaced after a month of absence. This was a month that we had pre-paid and received no services during. We had an impending court appearance in which he said that he should not attend or participate along with our existing counsel and to “just let them handle it”. We thought that was odd that he did not want to engage with our existing counsel on such a critical milestone given that he expressed his ability to add significantly to our case and supplement the work being done by our attorneys. The counter claim finally filed on 6/3/15 was found to be a frivolous document that only worsened our case and our position in this negotiation for our home. It put us in jeopardy of sanctions from the court, as well as our prior counsel. Then, when the backlash from his shoddy work ensued, he wrote a document he termed a ‘Notice of Withdrawal of Counsel’ that we learned is a document that does not even exist in law. He simply was trying to remove himself from the situation after he had created a serious issue that could penalize all of us financially. We went to his office to discuss the many issues regarding his work and his absence during the time he was retained to be working on our behalf. He filed a police report indicating that we had violated his home and other indications that were downright untrue. It is outrageous that someone could be so abusive to his or her own clients. He deemed our visit an invasion to his home stating that we entered his home uninvited, however his office is in his home and he DID invite us in. He says we entered without his consent – if he did not consent, why did he open the door? We did not force entry; we were with our sleeping four year-old daughter and the neighbor who referred us - he asked us in to discuss the concerns. His negligence continued as he did not contact our existing reputable counsel as he should have. He attempted to further sabotage our case after his withdrawal stating that our existing counsel should not continue with us and sent them a copy of the police report. Our counsel was furious and informed us that the documents filed did not exist in law and that we had been taken advantage of. Our counsel is supporting opposing counsel in requesting that the court seek sanctions for his mismanagement of our case. His involvement in our case dramatically worsened our situation and real lawyers are appalled by the 'work' he did.

I was really stressed and had almost given up, but once I contacted Brian Ponder he assured me that I would receive my money back in less than a week and in full. And yes the other attorney refunded me in f...ull!!!! I am so grateful and have recommend Brian Ponder Trial Lawyers to everyone I know. Any lawyer that can put fear in another lawyer knows his stuff!
