Traveling to Meet a Minor (13-CF-1355)
Nov 01, 2013OUTCOME: Prison Avoided; Given House Arrest and Probation
Law enforcement conducted an undercover investigation using Craigslist to look for individuals interested in having sex with minors. The Defendant responded to one of the ads posted by the undercover o ... fficer. An email exchange then took place between the Defendant and the undercover officer over the next several days. During these conversations the undercover officer indicated he was a 15 year old child who lived with his mother and went to school. The conversation at some point turned sexual and a meeting was arranged between the Defendant and the undercover officer. When the defendant traveled to the agreed upon location to meet with the undercover officer he had sexual paraphernalia on his person. Initially the State Attorney's Office offered the Defendant 15 years in prison for the offense. Mr. Kuhn vigorously investigated the case, conducting depositions and case law research as well as filing motions to dismiss. By utilizing his extensive experience handling Sex Offense Cases Mr. Kuhn was able to demonstrate the potential legal insufficiencies in the case to the State Attorney's Office. Based upon the issues pointed out to the prosecutor, as well as some criminal defense strategy, Mr. Kuhn was able to get the State Attorney's Office to reduce the offer to House Arrest followed by probation. The Defendant avoided significant prison time on the case.
