The plaintiff, a patron of the defendant hospital commenced a personal injury action against the defendant after suffering a slip and fall near a sidewalk located across the street from the hospital. T ... he plaintiff alleged claims sounding in premises liability as well as a claim involving the assumption of duty by a hospital escort that was directing the patron to his car at the time of the fall. The defendant moved for summary judgment as to all causes of action. The lower court denied summary judgment as to all claims and defendant appealed.
