OUTCOME: Not Guilty

My client was charged with Felony DWI while sleeping in his vehicle that was parked in lot of a local bar. It was January so the car was on to keep him warm. In New York you can be charged with DWI s ... imply for the car being on while your in the vehicle. I had him testify before the grand jury and he told them he was keeping warm. I also asked the A.D.A to have the bar manager testify that my client was at the bar all night and left at close. The grand jury found no Felony was comitted.
