Well if he was under 18 he did not accumulate illegal presence so you may petiton for him now via a fiancee visa.

You can file now. Both the I-130 and the I-485 as spouses of US citizens have visa numbers available to them - they are inmediate relatives.

Seek voluntary departure with CIS. You should do this via an immigration attorney. Voluntary Departure waives the 3 year bar.

If she were becoming a citizen she would not need a sponsor. She is probably becoming a resident. You do not need to be related or be her...

Contact an attorney that is a member of AILA. Look him or her up at www.aila.org. They have mechanisims by which to find out where your case is at.
