Yes. She may apply for a waiver based on bonafide marriage. She has to prove that the marriage was entered into in good faith.
I am a Us Citizen, I filing an I-130 for my mother and stepfather.They were married before I turned 18. Can I file for stepdad.

Yes you may as long as the marriage took place before you were 18. You also have to be 21.
Unintentionnaly overstayed, applied for an E2 visa which got turned down and now applying for tourist visa. Any chance?

You need to do a FOIA with CIS and a FOIA with the Immigration Court (EOIR). If you have the VD order it is evidence that you were in removal...
