My client was charged with DUII by the arresting Officer. However, the Marion County DA charged Reckless Driving. There was no evidence of intoxication in the record. Yet the police were trying to hint ... at drug use by my client to meet the "reckless" element. Two police officers and two witness who made 911 calls, allegedly based on my client driving, were called to testify. It was a half-day bench trial.
