OUTCOME: Not Guilty

Single vehicle accident. Client was contacted by a Trooper between 1/4 and 1/2 mile from the vehicle and was considered "extremely intoxicated." The Trooper testified that he was in the top 25 most i ... ntoxicated people he has ever contacted in close to 1,000 DUI investigations. However, the State was unable to establish that he was intoxicated at the time of driving, despite the Trooper testifying that my client admitted to not consuming any alcohol since driving. A Stevens County jury voted unanimously "Not Guilty" and acquitted my client after deliberating for more than an hour and a half.

OUTCOME: Case Dismissed

Client charged with DUI after being stopped for failing to turn into the first lane. Motion to dismiss filed. The defense argued, and the Court agreed, that the improper turn statute is not a strict ... liability statute, thereby requiring the state to make an additional showing to justify a stop when a driver fails to turn into the first lane. The State moved to "reconsider" - the defense moved to strike the State's motion, which was granted. The State then appealled the decision. The defense moved to "involuntarily dismiss the appeal" on the theory that the State had abandoned their appeal. The appellate court granted the motion and dismissed the appeal, effectively ending the case.
