Over a 2 year period the Port of Albany's counsel was able to secure reductions of the challenged assessments by more than $36.2 million. The matter was settled in Supreme Court with new assessments totaling approximately $19 million.

A citizen petition proposing two amendments to the City of Albany Charter was circulated pursuant to Municipal Home Rule Law. Respondent determined that the petition was insufficient in that it contain ... ed only 2,909 valid signatures, 122 signatures short of the 3,031 required in order for it to be placed on the ballot in the general election. Petitioner commenced a proceeding seeking to validate 224 of the 766 invalidated signatures. In his affirmation in opposition, respondent, among other things, identified 170 signatures which were counted as valid but which he now sought to find invalid. An application was filed to validate the petition for referendum seeking to amend city charter. The Albany County Supreme Court (J. Spargo) dismissed the Petitioners' application. The Petitioner appealed.
