Thank You So Much

Michael Maltby has been a great person,asset to me, my case and to my family. He has always been available to any questions or call or answer any questions or concerns i may have. He was there at every hearing. And he always made sure i understood anything i ds not know or did not feel comfortable ...with. He tried his best to help me get throuhh my situation n the best way VB possible to accommodate me and my or concerns. I feel he took the time to research the truth. I feel the outcome could have been a little more fair but i am so very blessed and very thankful for mr maltbys time and effort

Truly everything one hopes to find in a competent defense attorney!

I drew Mike Maltby as my court appointed defense attorney in December of 2010 when I was arraigned on felony assault charges (i.e., Felony Harassment and Assault). Although the details surrounding the incident which resulted in the charges filed were such that most persons might not be terribly conce...rned with the outcome of the proceedings (I was awakened on the morning after Thanksgiving by an intruder in my home, and was facing criminal charges for allegedly assaulting and [verbally] threatening to kill the intruder), my extensive criminal history and the lack of witnesses supporting my claims of household defense gave adequate cause for me to be legitimately concerned for the outcome of these very serious charges. Because my personal experience with court appointed counsel has never been positive enough for me to develop a favorable opinion of attorneys working under assigned conditions, I was giving serious consideration to selling everything but my immortal soul to retain the best representation my meager finances could afford. Nevertheless, seeking to be compliant with the directives of my release conditions, I contacted Mr. Maltby via telephone upon being released on bail. My first interaction with Mike was a lengthy [phone] conversation wherein, despite his statement that he was very busy and did not have much unscheduled time to give me at the moment, he demonstrated genuine interest and seemingly infinite patience as he took the time to listen to and query me on the details of my case. Feeling reassured by the intuitive insight and professionalism he demonstrated during more than an hour of conversation, I remember wondering, after I hung-up the phone, if this guy was aware of how little assigned counsel received as compensation for their efforts. Needless to say, I postponed my "everything must sell!" garage sale. I met Mike Maltby in person for the first time at my home, where he interviewed me and carefully examined the scene of the alleged crime(s). Once again I found him to be intuitive and very easy to talk to. As our visit ended, having been completely honest and still being uncertain whether I was technically guilty of a crime, I asked Mike if, in his opinion, I was guilty of a crime and if so, whether I should seek a lucrative plea agreement. Although as court appointed counsel I expected him to seek any opportunity for an expeditious resolution, Mike, to his credit, surprised me again. He told me that it was not his job to determine guilt or innocence, but rather to provide the very best defense counsel he possibly could, and that he intended to do nothing less. Period. He also expressed genuine sympathy for the difficulties I was experiencing as a result of the incident, and advised me not to be so quick to condemn myself. In the weeks that followed, Mike never failed to uphold the highest ethical standard as he tirelessly pursued my acquittal via multiple defense strategies. On April 6th, much to my amazement, he presented me with an agreement for a recommended sentence of three days in jail (with credit for time served) in exchange for a plea of guilty to the charge of Fourth Degree Assault, a misdemeanor. Although Mike was determined to battle for my acquittal at trial if necessary, I graciously accepted the plea agreement, preferring this speedy resolution to the potential consequence of a worst case scenario. Tomorrow I will face a Superior Court Judge for sentencing with Attorney, Mike Maltby at my side and, regardless of the outcome, I can honestly say that I have never before in my life felt so well represented.
