In 16 years of defense work, I have never seen a "victim" charged with false statements. But all the information you provided, perhaps even that...

It sounds like both are a real possibility. But your first concern is your own safety. Call a shelter for donestic violence and create a safety plan.

It is mote difficult to find an error in the procedure and testing to get the result thrown out if you dis not take the test. But it depends on why...

Are you prescribed oxy? Was that a regular dose of oxy for you? Why dis the Officer stop you? Consult with a DUI lawyer as soon as you are able.
