Transactions. I have over 36 years of experience with the business aspects of enterprises developing and offering new technologies, products or services, where they are created, developed, protected, sold and/or licensed under the laws of Intellectual Property Rights ("IPR"). IPR includes brands (trademarks, service marks, trade dress), copyrights, trade secrets, invention and other industrial property rights. In the past 20 years, some clients have been in the top 20 fastest growing privately-held companies in the Puget Sound area or state-wide or nationally. My clients range from start-up to now mature companies. My IPR licensing and business practice is global. Clients are in such industries as medical technologies, publishing (software, art, literary), consumer products, restaurants and manufacturers. I do not provide application services for registrations of trademarks, copyrights or patents.
Disputes. Until 2010, about 50% of my practice over the previous 33 years, involved litigation, trials and arbitrations, where parties have disputes over Intellectual Property Rights ("IPR"). For example, I was lead counsel in disputes over IPR ownership, infringement claims and other torts (such as misappropriation of trade secrets), licensing and other breach of contract claims, and federal and state related claims involving false advertising or unfair and deceptive business practices. My hands-on experience with lawsuits and arbitrations, including trials, have given me a practical perspective on what "best practices" should be followed with licensing and other transactions and also with decades of experience with common problems with the commercialization and business of IPR. I decided in 2010 to devote my entire practice to transactions involving IPR.
